Building & Construction News Alert: Proclamation of Queensland Building and Construction Industry Payments Amendment Act 2014

The Governor in Council has proclaimed that the commencement of the Building and Construction Industry Payments Amendment Act 2014 is 15 December 2014.

Consequences of Proclamation

All contracts entered into on or after 15 December 2014 will have all the new provisions applying to it, including:

  • New time periods for complex and standard claims.
  • New provisions in relation to default of payment schedules.

Regardless of when a contract was entered into the new definition of ‘business day’ will apply and business days not included in the reckoning of time include:

  • 22 to 24 December 2014
  • 27 to 31 December 2014
  • 2 to 10 January 2014

While this new definition during the vacation break is welcome, parties should be ever vigilant concerning claims that arise during periods where there are less staff available to check emails, faxes, mail etc.
